EAT Benefit Terms and Conditions

NOTICE TO SUBSCRIBERS AND USERS: THIS IS AN IMPORTANT DOCUMENT WHICH EXPLAINS THE BENEFIT TERMS AND CONDITIONS OF THE EAT PROGRAMME – PLEASE READ IT CAREFULLY AND PAY CLOSE ATTENTION TO CLAUSES IN BOLD TEXT.

These terms and conditions (the “Terms”) govern your use of our cashback dining and fast food conditional voucher benefit as part of the EAT application, the EAT loyalty programme and our services (collectively, the “EAT Interface”). By using or accessing the EAT Interface, you agree to be bound to these Benefit Terms. If you disagree with any part of these Terms, you must immediately stop using the EAT Interface or any part thereof.

PLEASE READ OUR PRIVACY STATEMENT AND THE FOLLOWING TERMS BEFORE USING THE EAT INTERFACE.

BY CONTINUING TO ACCESS OR USE THE EAT INTERFACE, YOU WARRANT THAT YOU HAVE READ, UNDERSTOOD AND HAVE AGREED TO BE BOUND BY THESE TERMS.

  1. EAT Dining Benefit:
    1. The EAT dining benefit (the “Dining Benefit”) entitles you, as a monthly subscriber, to buy 1 (one) meal and get refunded on the second most expensive meal, up to a maximum value of R120 (one hundred and twenty Rand).
    2. The Dining Benefit can be used at over 1 500 (one thousand five hundred) participating restaurants countrywide.
    3. Refund claims are processed by DR and not by the restaurant.
    4. All Dining Benefit queries and questions should be referred to DR by calling 087 825 0040 or by emailing claims@eatapp.co.za.
    5. The Dining Benefit is subject to the following conditions (depending on Lockdown rules):
      1. you must be dining with at least 1 (one) other person;
      2. no less than 2 (two) dining main meals and 2 (two) drinks are purchased on your subscription;
      3. you must request online delivery with at least 1 (one) other person;
      4. no less than 2 (two) online delivery or take away main meals and 2 (two) drinks are purchased on your subscription;
      5. you are at least 18 (eighteen) years of age;
      6. you are a paid-up subscriber of EAT;
      7. You have not exceeded your maximum dining benefits for that month (where applicable);
      8. the Dining Benefit can only be redeemed at participating restaurants which can be found on the EAT application. We shall be entitled, in our sole and absolute discretion, to amend the list of restaurants from time to time. Whilst every effort will be made to ensure that all listed restaurants are trading, DR shall not be held liable in the event of any restaurant closures;
      9. the Dining Benefit is based on the relevant restaurant’s standard prices and cannot be used with any special offers, promotions, other discount vouchers or other loyalty programs;
      10. you may only use the Dining Benefit once per restaurant per day;
      11. the Dining Benefit does not apply to starters, desserts, extras, toppings, sides (e.g. build your burger, extras on pizza etc.);
      12. the refund applies to individual line items on the menu whereby only 1 (one) discount applies;
      13. the Dining Benefit can be used for courses that include drinks, provided it is not a special; and
      14. a maximum of 2 (two) subscriptions may be used per table of 4 (four) people, provided they are under different names and each subscriber must claim separately;
      15. claims must be submitted via the EAT application within 24 hours from your restaurant visit or order delivery.
    6. The refund will be calculated on the second most expensive meal on the bill, up to a maximum of R120.00 (one hundred and twenty Rand). Your claim may be verified with the relevant restaurant to ensure validity.
    7. Can only be used a maximum of 3 times per day and up to a maximum of R 1,200 approved refunds per month;
    8. Is not applicable with any special offers, promotions, discount vouchers or loyalty programs;
    9. Can be used when purchasing takeaways directly from a listed restaurant or the third-party take away providers Mr D, Uber Eats, Bolt and Order In;
    10. Your claim will be processed within 5 (five) Working Days (defined as Mondays to Fridays, excluding South African public holidays).
    11. Your refund will be calculated as follows:
      1. subscription 1: 2nd most expensive dining meal on the bill up to a maximum of R120 (one hundred and twenty Rand) with a minimum of 2 (two) drinks; and
      2. subscription 2: 4th most expensive dining meal on the bill up to a maximum of R120 (one hundred and twenty Rand) with a minimum of 4 (four) drinks.
    12. Claims:
      1. must be submitted via the EAT application within 24 hours from your restaurant visit or online delivery order;
      2. will be deposited into the bank account in the name of the subscriber only; and
      3. must include a complete and legible claim submission.
      4. must include the original restaurant receipt clearly displaying the restaurant name, receipt number, date and time (credit card receipts not accepted) in the form of a clear photo and will not be processed if the details on your receipt (restaurant name, date) do not match your “claim” or if the time of payment is more than 24 (twenty-four) hours from your “claim” time.
    13. Your subscription to EAT is non-transferable.
    14. Clients can submit their restaurant or online delivery receipts from suppliers such as Mr D, Uber Eats, Bolt, Order In, subject to the restaurant being part of the current selected restaurants.
    15. EAT and its service providers are in no way affiliated with any of the third-party delivery operators mentioned in this benefit. The choice to make use of these delivery operators is solely at the discretion of the restaurant involved.
    16. EAT and/ or DR accepts no responsibility for the quality of service and/ or meals at any of our dining partners. Furthermore, EAT and/vor DR will not become involved in any disputes between members, delivery operators and restaurants.
    17. All receipts must have the following information present:
      1. Order date and time together with order/ receipt number – this should be aligned to the claim submitted on the App;
      2. Minimum of 2 meals;
      3. Minimum of 2 drinks;
      4. The total value of the invoice excluding the delivery charge must be visible on the receipt;
      5. Any delivery charge will not be considered for a refund.
    18. At DR’s discretion, we may request proof of payment to be submitted along with any pro forma invoices that are submitted e.g. credit card slip, Zapper, Snapscan receipt or cash receipt.
    19. Payments will not be processed if the details on any receipt (restaurant name or date) does not match the authorisation or if the time of payment is over 5 (five) hours from the relevant authorisation time. Should you wish to reschedule your restaurant visit, a new claim and receipt must be submitted within 24 hours on the EAT application. Backdated authorisations will not be allowed by DR under any circumstances.
    20. Any subscriber who fails to adhere to, or attempts to circumvent, the applicable Terms or abuse the Dining Benefits may result in the termination of their eligibility to receive the Dining Benefits in the future. DR shall not be held liable for any losses should a subscriber be denied access to the Dining Benefits on the basis of this clause.
    21. You may not deduct, withhold, bank exchange, commission or set-off any amounts from amounts which are owed to us, without our prior written consent.
    22. EAT and/ or DR may amend its terms and conditions from time-to-time.
  2. EAT Fast Food Benefit:
    1. The EAT fast food benefit (the “Fast Food Benefit”) entitles you, as a monthly subscriber, to a conditional discount voucher on your next fast food meal purchased from a participating store, provided that you:
      1. spend R250 (two hundred and fifty Rand) or more, excluding the delivery fee, to qualify for a R50 (fifty Rand) voucher, redeemable off your next purchase of R100 or more; or
      2. spend R150 (one hundred and fifty Rand) or more, excluding the delivery fee, to qualify for a R30 (thirty Rand) voucher, redeemable off your next purchase of R100 or more; or
    2. You are entitled to additional fast food benefits for certain Brand specific conditional discount vouchers on your next meal purchased from these participating stores, provided that you:
      1. spend R199.90 (one hundred and ninty nine Rand) or more, excluding the delivery fee, to qualify for a R30 (thirty Rand) Debonairs Pizza voucher, redeemable off your next purchase of R100 or more; or
      2. spend R300 (three hundred Rand) or more, excluding the delivery fee, to qualify for a R50 (tfifty Rand) Debonairs Pizza voucher, redeemable off your next purchase of R100 or more; or
      3. spend R75 (seventy five Rand) or more excluding delivery fee, to qualify for a R15 (fifteen Rand) Milky Lane voucher, redeemable off your next purchase of R50 or more; or
      4. spend R150 (one hundred and fifty Rand) or more, excluding delivery fee, to qualify for a R30 (thirty Rand) voucher, redeemable off your next purchase of R50 or more.
      5. submit your claim within 24 (twenty-four) hours from visiting the participating outlet or ordering through the respective fast food mobile application (e.g. the Steers, Nando’s App).
    3. For the respective fast food mobile application voucher redemptions, you will need to adhere to the respective mobile application terms and conditions.
    4. You will also need to enter the voucher number on the respective fast food mobile application before selecting the payment method.
    5. In order to spend the conditional voucher, a minimum order of R100 excluding the delivery fee is required on your next purchase; except for Milky Lane where a minimum order of R 50 excluding delivery fee is required on your next purchase;
    6. All claim submissions will be vetted and approved by DR based on the above criteria.
    7. The discount voucher will be calculated as per the qualifying criteria and the amount spent on the bill, up to a maximum of R50.00 (fifty Rand), R30.00 (thirty Rand) and R15.00 (fifteen Rand) in terms of clause 2.1 and 2.2.
    8. Your claim will be processed within 3 (three) Working Days.
    9. The Fast Food Benefit:
      1. can only be redeemed at participating outlets. We shall be entitled, in our sole and absolute discretion, to amend the list of outlets from time to time. Whilst every effort will be made to ensure that all listed outlets are trading, DR shall not be held liable in the event of any restaurant closures; and
      2. your voucher is valid for 1 (one) use and once per outlet per day only;
      3. you cannot use 2 (two) vouchers for one purchase;
      4. you are limited to 4 (four) claims per subscription month;
      5. claims must be submitted within 24 hours of purchase;
      6. you must redeem within 30days from date of voucher issue;
      7. is based on the outlet’s standard in-store and online prices;
      8. applicable with any special offers, promotions;
      9. not applicable in conjunction with other discount vouchers or loyalty programs;
      10. applies to individual line items on the menu whereby only 1 (one) discount applies; and
      11. applies to meals that include drinks.
